Bond Proceedings

The Immigration and Nationality Act (INA) provides for the release of certain noncitizens arrested for immigration violations on bond or on their own recognizance, except for those who may be subject to mandatory detention (due to criminal or terrorist grounds). The Attorney General may release noncitizens on a bond. Once detained, the local office of United States Immigration and Customs Enforcement (ICE) makes the initial custody and bond determination.
